Terms of Service

1. Who We Are

Cue is a product of Caldea Labs LLC, a limited liability company registered in Puerto Rico. When we say “Cue,” “we,” “us,” or “our,” we mean Caldea Labs LLC. When we say “you” or “your,” we mean you, the individual or entity using Cue.

Cue is an AI-powered assistant that lets real estate professionals manage their Follow Up Boss (FUB) CRM through text and voice messages. Cue is not affiliated with, endorsed by, or sponsored by Follow Up Boss or Lone Wolf Technologies.

2. Acceptance & Eligibility

By creating an account, accessing, or using Cue in any way, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, do not use Cue.

You must be at least 18 years old to use Cue. By using Cue, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using Cue on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.

3. Your Account

You create an account with your email and password, then connect your Follow Up Boss account via OAuth or API key. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@caldea.ai if you suspect unauthorized access.

Accounts are for individual use only. You may not share your account credentials with others or allow multiple individuals to access Cue through a single account.

Cue is available on the web and iOS. Android support is planned but not yet available.

4. What Cue Can and Cannot Do

Cue can read, create, and update contacts, deals, tasks, appointments, notes, call logs, action plans, automations, tags, smart lists, text message records, and relationships in your Follow Up Boss account. Cue can also draft emails and SMS from templates, transcribe voice memos, and analyze photos and documents such as business cards and contracts.

Cue cannot:

• Delete any records in Follow Up Boss
• Automatically send messages to your contacts (drafted messages are always presented for your review)
• Access CRM data outside of your Follow Up Boss account

5. Billing & Subscription

Cue is offered at a flat rate of $29 per month. Payment is processed through Stripe. You can update your payment method, view invoice history, cancel, or resubscribe at any time through your account settings or the Stripe customer portal.

Cancellation. You may cancel your subscription at any time. Upon cancellation, you will retain access to Cue through the end of your current billing cycle. No refunds are provided for partial billing periods.

Billing errors. If you believe you have been charged in error, contact us at support@caldea.ai within 30 days of the charge. We will review the charge and issue a refund if appropriate.

6. Acceptable Use

Cue is designed for licensed real estate professionals managing their CRM. You agree that you will not:

• Use Cue for any unlawful, fraudulent, or deceptive purpose
• Share, transfer, or sell access to your account
• Allow unlicensed individuals to manage a licensed agent's CRM through your account
• Use Cue to send or facilitate unsolicited bulk communications or spam
• Attempt to reverse-engineer, decompile, or extract source code from Cue
• Interfere with or disrupt the service, servers, or networks connected to Cue
• Attempt to gain unauthorized access to other users' accounts or data
• Use Cue in any way that violates applicable federal, state, or local laws or regulations, including real estate licensing laws and the Telephone Consumer Protection Act (TCPA)

We reserve the right to suspend or terminate your account for any violation of this section, with or without notice.

7. Intellectual Property

All rights, title, and interest in Cue—including its software, design, branding, logos, and documentation—are and remain the exclusive property of Caldea Labs LLC. These terms do not grant you any ownership rights in Cue.

You retain all rights to your CRM data and the content you provide through Cue. By using Cue, you grant us a limited, non-exclusive license to process your data solely to provide and improve the service.

8. AI Accuracy & Disclaimer

Cue uses artificial intelligence to interpret your requests and interact with your CRM. AI systems are non-deterministic, which means they can and will occasionally make mistakes, including misinterpreting instructions, creating incorrect records, or updating the wrong fields.

Cue is instructed to confirm before creating new contacts, but as an AI system, it may occasionally act without confirmation. You are solely responsible for reviewing and verifying any changes Cue makes to your Follow Up Boss account. Caldea Labs LLC is not responsible for errors, omissions, or unintended actions performed by the AI.

9. How We Handle Your Data

CRM Data

CRM data is not permanently stored. Raw CRM records from Follow Up Boss are fetched in real time and are not persisted on our servers. Cue can read, create, and update records but cannot delete anything in Follow Up Boss.

Conversation History & Retention

Cue retains your most recent 30 messages to maintain conversation context. This window may contain CRM data referenced during your interactions (such as contact names or deal amounts). Older messages are automatically trimmed. You may request deletion of your conversation history at any time by emailing support@caldea.ai.

AI Providers & Model Training

Cue uses Anthropic (Claude) for CRM operations and OpenAI for voice transcription only. Your data is sent to these providers solely for inference—processing your requests in real time. No user data is sent to Anthropic or OpenAI for model training. Your conversations are never used to train or fine-tune any AI model.

Credentials & Authentication

Your Follow Up Boss API keys and OAuth tokens are encrypted at rest using industry-standard encryption (AES-256 or equivalent). OAuth tokens refresh automatically and expire after 90 days of inactivity. Your account password is cryptographically hashed by our database provider—we never have access to your password in plain text.

Voice Memos & Photos

Voice memos are transmitted to OpenAI's API for transcription and are not stored after processing is complete. The resulting transcription becomes part of your conversation history (subject to the 30-message retention window). Photos and images sent to Cue are processed during your request and are not stored permanently.

Audit Trail & Usage Logging

We maintain a PII-free audit trail that records action types and entity IDs only—no names, emails, phone numbers, or message content. We also log anonymized usage metrics (token counts, cost, timestamps) for service operation. These logs do not contain message content or CRM data.

Data Location

All data is processed and stored in the United States.

Cookies

We use essential cookies for authentication and session management only. We do not use tracking cookies, advertising cookies, or third-party analytics.

10. Third-Party Services

Cue integrates with the following third-party services, each of which operates under its own terms of service and privacy policy:

• Follow Up Boss (CRM integration)
• Stripe (payment processing)
• Apple App Store (mobile distribution)
• Anthropic (Claude AI for CRM operations)
• OpenAI (voice transcription)

Caldea Labs LLC is not responsible for the availability, performance, accuracy, or data practices of any third-party service. Your use of these services is subject to their respective terms.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• No consequential damages. Caldea Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, business opportunities, or goodwill, arising out of or in connection with your use of Cue.
• Liability cap. Our total cumulative liability for all claims arising out of or related to these terms or your use of Cue shall not exceed the total amount you paid to Caldea Labs LLC in the twelve (12) months preceding the event giving rise to the claim.
• As-is service. Cue is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• No guarantee of availability. We do not warrant that Cue will be uninterrupted, error-free, secure, or free of harmful components.

12. Indemnification

You agree to indemnify, defend, and hold harmless Caldea Labs LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of Cue or any actions taken in your Follow Up Boss account through Cue
• Your violation of these Terms of Service
• Your violation of any applicable law or regulation
• Any claim by a third party resulting from your CRM data or communications facilitated through Cue

13. Dispute Resolution

Informal resolution first. Before filing any legal action, you agree to contact us at support@caldea.ai and attempt to resolve the dispute informally for at least thirty (30) days.

Binding arbitration. If we cannot resolve the dispute informally, either party may elect to resolve the dispute through binding arbitration administered under the rules of the American Arbitration Association (AAA). Arbitration will be conducted on an individual basis in Puerto Rico (or remotely, by mutual agreement). The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.

Class action waiver. You and Caldea Labs LLC agree that any disputes will be resolved on an individual basis only. Neither party may bring a claim as a plaintiff or class member in any class action, consolidated action, or representative proceeding.

Exceptions. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

14. Termination

By you. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle.

By us. We reserve the right to suspend or terminate your account immediately, with or without notice, for violation of these terms, suspected fraud, or conduct that we reasonably believe is harmful to Cue, other users, or third parties.

Effect of termination. Upon termination, your right to access Cue ceases immediately (or at the end of your billing cycle, if you cancel voluntarily). Sections 7, 8, 9, 11, 12, 13, and 15 survive termination.

15. Account Deletion

You may request full account deletion by emailing support@caldea.ai. Upon receiving your request, we will permanently delete your user record, conversation history, audit logs, and usage data within thirty (30) days. Deletion is irreversible. We may retain anonymized, aggregated data that cannot be used to identify you.

16. Changes to These Terms

We may update these terms from time to time. When we do, we will post the updated terms on our website and notify you by email or through the app. Changes take effect when posted. Your continued use of Cue after changes are posted constitutes acceptance of the updated terms. If you do not agree, you may cancel your subscription.

17. Governing Law

These terms are governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-law provisions. To the extent that litigation is permitted under Section 13, the exclusive jurisdiction and venue shall be the courts located in Puerto Rico.

18. General Provisions

Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and Caldea Labs LLC regarding your use of Cue and supersede all prior agreements.

Severability. If any provision of these terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations without restriction.

Force majeure. Caldea Labs LLC shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, internet outages, third-party service failures, or government actions.

Notices. All notices under these terms will be sent to the email address associated with your account. It is your responsibility to keep your email address current.
